The Note says that Bush doesn’t really care that deeply about the Charles Pickering nomination, but may be doing it because the Democrats won’t be able to easily filibuster other judges. (You can only do so many judge filibusters before it becomes a major campaign issue. Only once before has a judge been successfully filibustered – Abe Fortas’ nomination to be Supreme Court Chief Justice in 1968.)
Also, it doesn’t hurt that Pickering is a Lott protege and nominating him will help appease the former to-be majority leader.
