Now, Watch the Far Left Squirm
Courtesy of the Volokh Conspiracy, the following is a passage from a legal brief on which Judge Roberts worked back in the early-1990’s, prior to his ascent to the D.C. Circuit Court of Appeals:
We continue to believe that Roe was wrongly decided and should be overruled. As more fully explained in our briefs, filed as amicus curiae . . . the Court’s conclusions in Roe that there is a fundamental right to an abortion and that government has no compelling interest in protecting prenatal human life throughout pregnancy find no support in the text, structure, or history of the Constitution.
Now, sure, while that blogger at Volokh certainly is correct that attorneys can and do author legal briefs without necessarily injecting their personal viewpoints therein, the bottom line is that Judge Roberts arguably is the most conservative/originalist jurist on one of the more conservative/originalist courts anywhere in the country.
Once confirmed, Justice Roberts will be aligned with Justices Scalia and Thomas.
And as Alex McClure already pointed out, Roberts is real, real young. Barring something unforeseen, he’ll be on the SCOTUS for 30-plus years.
